Acceptance of Terms

By accessing or using Creaxe (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Platform. We reserve the right to modify these Terms at any time, and your continued use after changes constitutes acceptance of the revised Terms.

Account Registration

To use certain features of Creaxe, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security and confidentiality of your login credentials
  • Promptly update your account information if it changes
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent to use the Platform.

User Content and License

Your Content

You retain ownership of all content you create, upload, or generate using Creaxe (“User Content”). By using the Platform, you grant Creaxe a worldwide, non-exclusive, royalty-free license to host, store, and display your User Content solely for the purpose of operating and providing the Platform’s services to you.

Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the necessary rights to use and authorize the use of your User Content
  • Your User Content does not infringe upon the intellectual property rights of any third party
  • Your User Content complies with all applicable laws and these Terms

Prohibited Uses

You agree not to use Creaxe to:

  • Violate any applicable law, regulation, or third-party rights
  • Upload, create, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
  • Generate or distribute child sexual abuse material (CSAM) or any content exploiting minors
  • Impersonate any person or entity or misrepresent your affiliation
  • Attempt to gain unauthorized access to the Platform or its systems
  • Interfere with or disrupt the Platform’s infrastructure or other users’ experience
  • Use automated scripts, bots, or scraping tools without our express permission
  • Resell, redistribute, or sublicense Platform features or AI-generated content as a competing service

AI Content Policy

When using Creaxe’s AI-powered features, you agree to:

  • Not generate content that violates any applicable laws or regulations
  • Not use AI tools to create deceptive deepfakes, misinformation, or content intended to mislead
  • Not attempt to generate content depicting real individuals without their consent
  • Accept that AI-generated content may not always be accurate, appropriate, or unique
  • Acknowledge that similar AI outputs may be generated for other users based on similar prompts

You own the AI-generated content you create through the Platform, subject to these Terms and our Acceptable Use Policy.

Intellectual Property

The Platform, including its design, code, features, templates, graphics, and branding, is owned by Creaxe and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our written consent.

Templates and assets provided through Creaxe are licensed for your personal and commercial use in your designs, but may not be redistributed as standalone assets or template packs.

Subscription and Payments

Free and Pro Plans

Creaxe offers both free and paid subscription plans. Pro subscriptions provide access to premium features, templates, and AI credits as described on our pricing page.

Billing

  • Subscriptions are billed on a recurring basis (monthly or annually) at the rate in effect at the time of purchase
  • You authorize us to charge your selected payment method for all applicable fees
  • Prices may change with 30 days’ advance notice

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing cycle. See our Refund Policy for details.

AI Credits

AI credits are a consumable resource used to access AI features. Credits do not expire while your account remains active. Unused credits are non-transferable and have no cash value.

Termination

We may suspend or terminate your account at our sole discretion if:

  • You violate these Terms or our Acceptable Use Policy
  • Your account has been inactive for an extended period
  • We are required to do so by law
  • We discontinue the Platform or any part of it

Upon termination, your right to use the Platform ceases immediately. We will make reasonable efforts to allow you to export your content before deletion, except in cases of severe policy violations.

Disclaimers

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that:

  • The Platform will be uninterrupted, error-free, or secure
  • AI-generated content will be accurate, appropriate, or free from bias
  • Results obtained from the Platform will meet your expectations
  • Any errors or defects will be corrected

Limitation of Liability

To the maximum extent permitted by law, Creaxe and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to Creaxe in the 12 months preceding the claim.

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Creaxe operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the competent courts of that jurisdiction.
